Le principali funzioni dell’Agcom includono:

  1. Regolazione del settore delle telecomunicazioni e dei servizi postali: L’Agcom stabilisce norme e regole per garantire un mercato competitivo e trasparente.
  2. Tutela dei diritti degli utenti: L’agenzia si occupa di garantire la protezione dei diritti dei consumatori e degli utenti nei servizi di comunicazione.
  3. Sorveglianza della qualità dei servizi: Agcom monitora la qualità dei servizi offerti dagli operatori di telecomunicazioni e dei fornitori di contenuti.
  4. Controllo della pubblicità: L’agenzia si occupa di vigilare sulla pubblicità, in particolare quella destinata ai minori e relativa alle comunicazioni.
  5. Gestione delle frequenze radio: L’Agcom coordina l’assegnazione delle frequenze radio e televisive per garantire il buon funzionamento delle comunicazioni.
  6. Promozione della libertà di espressione e della pluralità dell’informazione: L’agenzia lavora per difendere la libertà di informazione e garantire che ci sia una varietà di voci e opinioni nei media.

La struttura dell’Agcom

Il Consiglio dell’Agcom (Autorità per le Garanzie nelle Comunicazioni) è composto da cinque membri, di cui uno ricopre il ruolo di Presidente. La composizione del Consiglio è la seguente:

  1. Presidente: è il rappresentante dell’Autorità e ha la responsabilità di coordinare le attività del Consiglio.
  2. Quattro Commissari: Questi membri supportano il Presidente e partecipano alle decisioni deliberative dell’Agcom.

I membri del Consiglio dell’Agcom sono nominati tramite un procedimento di selezione che coinvolge diverse istituzioni, tra cui il Parlamento italiano e il Governo. In particolare, due membri sono nominati dalla Camera dei Deputati, due dal Senato della Repubblica e il Presidente è nominato dal Presidente della Repubblica su proposta del Governo.

Furthermore, with the growing influence of digital platforms, AGCOM has had to exercise greater oversight over these services, regulating aspects such as advertising and the processing of personal data.

Agcom has also intensified its efforts to ensure the plurality of information and combat concentrations of power in the media , considering the importance of the diversity of voices in the information landscape.

Global challenges such as public health, data security, and climate change have prompted the agency to consider issues of global relevance, including in the telecommunications sector. These factors have contributed to an increase in AGCOM’s activity and involvement, as the agency adapts to an ever-changing communications landscape and strives to ensure a fair and transparent environment for all stakeholders.

How does Agcom act against piracy?

Agcom takes very decisive action, especially against piracy and copyright infringement, through various measures and strategies, including: To this end, it conducts monitoring activities to identify websites and platforms that infringe copyright and promote pirated content . This activity is aimed at identifying and reporting violations. The agency intervenes directly with hosting providers, Internet access providers, and other operators to remove or disable access to content that infringes copyright.

The authority has also established specific procedures through which copyright holders can report infringements and request action to protect their works. This is achieved through collaborative efforts between Agcom and other competent institutions, such as the Postal Police and trade associations, to combat piracy and promote legality in the communications sector.
